Sheriff's Office counsel: rescind the October 28, 2025 letter and restore equal treatment and protection of one family

Who this petition asks to act

Our story

On October 28, 2025, the Office's then Chief Legal Counsel wrote Chris "go ahead, and make my day," barred contact "for any reason other than an emergency call to 911" (letter p. 4), and refused to correct an earlier report (letter p. 3). Our lawsuit alleges it bars our household, School Resource Officers included (SAC p. 39).

The lawyer who wrote the October 28, 2025 letter had, two years earlier, agreed in a North Carolina Business Court case that references to his personal behavior would be described as "scandalous personal conduct" (Wijewickrama v. Christian, 2023 NCBC 55 (N.C. Super. Ct. Aug. 11, 2023), ¶¶ 66 to 67(e)).

On February 20, 2024, the Village asked the Office whether what Tori said Detective Trull told her were "factual statements" (email, p. 3). On Tori's recording of their call, the detective describes what the Village asked him and what he understood it to be doing. His words, as transcribed: the Village "had to ask me questions about what you had said and if I disagreed or agreed with everything. I was like, I mean, all that stuff is stuff that I said" (10:05 to 10:25), and "they're trying to, whatever they are, trying to discredit the info that you got from me or whatever the case is" (10:32 to 10:42). He added: "they have a deputy assigned to them that can give the same exact information" (10:49) (transcript).

A November 4, 2025 threat report was "Closed/leads Exhausted" January 2, 2026; no one told us (report; response). On November 14, 2025, Chris called 911 for Internal Affairs, not Lt. Maye; Lt. Maye called him (SAC p. 25; referral).

We call this a whitewash: on May 26, 2026 the Sheriff's litigation counsel wrote "Brandon is no longer employed by the Sheriff" (record); on June 10 he announced a move to a private firm (post); accounts named Eddie Cathey, James Maye and Tabitha Rogers, the Internal Affairs lieutenant our referral went to (referral), congratulated him (comments; comment); the District Attorney has not answered our requests for the SBI and FBI (demand; referral); the letter stands (SAC p. 25).

Since she left office

Kim Vandenberg left the Council in December 2025 (SAC p. 4).

The record proves the dates, not the cause.

On August 25, 2026, an X account that we believe is Adam Kuykendall's, as reported by Corey DeAngelis and Townhall, "liked" a reply saying Mr. DeAngelis should "get Kirk'd" on a photo of his family (Townhall; X). We have not been able to confirm the account's identity independently.

What we ask

  1. Mr. Stokes: rescind the letter in writing; restore our household's non-emergency access; correct the two reports above; refer the conduct to Internal Affairs, not Lt. Maye.
  2. Sheriff Cathey and Chief Deputy Underwood: confirm the rescission and equal services.
  3. District Attorney Robison: answer our referrals in writing.
  4. State Auditor, SBI, FBI: review whether the Office used public resources against one family's speech.

What Marvin's Council can do

By recorded vote, say "Get Kirk'd" and threats to our family and this Council are not okay, and it is false the Village cannot settle without Kim Vandenberg or must pay for any out-of-scope misconduct by her: the statute says "may," not "must" (G.S. 160A-167).
